These Terms of Service ("Terms") govern your use of Container Companies LLC ("Container Companies", "we", "our") services, website, and applications. By using our services, you agree to these Terms.
Services
Container Companies sells, rents, and delivers shipping containers in Louisiana, Mississippi, Alabama, and surrounding regions. Services include:
- Container sales (one-time purchase)
- Container rentals (monthly recurring)
- Rent-to-own programs
- Delivery and pickup logistics
Eligibility
You must be at least 18 years old and able to enter binding contracts to use our services.
Account and orders
You agree to provide accurate, complete information when placing orders, signing rental agreements, or creating accounts. You are responsible for maintaining the confidentiality of any account credentials.
Pricing and payment
All prices are in U.S. dollars unless otherwise noted. Payment terms are specified at the time of order or in your rental agreement. We reserve the right to change pricing for new orders at any time.
Payment processing
Card payments are processed securely by our payment processor. A 4% credit card processing surcharge may apply to card payments. To avoid the surcharge, customers may pay via Zelle on delivery (subject to prior arrangement).
Authorization holds
For certain orders, we may place an authorization hold on your card prior to delivery. The hold reserves funds for the transaction but does not transfer them. The hold is captured upon delivery or released if the order is cancelled or the customer pays via an alternative method.
Delivery
Delivery dates and times are estimates. We are not liable for delays caused by weather, traffic, depot availability, or other factors outside our reasonable control. Customers are responsible for ensuring delivery sites are accessible and prepared for container placement.
Rentals and rent-to-own
Rental and rent-to-own agreements are governed by their specific contract terms, which take precedence over these Terms where they conflict. Late payments may incur fees as specified in the agreement. Containers remain the property of Container Companies until full purchase price is paid (for rent-to-own) or returned (for rentals).
Refunds and cancellations
Refund and cancellation policies are specified at the time of order. Generally:
- Sales: refunds available before delivery; after delivery, restocking fees may apply
- Rentals: cancellation requires advance notice as specified in the agreement
- Pre-delivery authorizations: voided at no charge if cancelled before pickup
Acceptable use
You agree not to use our services for unlawful purposes, harass our staff or drivers, or interfere with our operations.
Communications
By using our services, you agree to receive transactional and operational communications including SMS, email, and phone calls related to your orders, deliveries, and account. See our SMS Communications Policy for SMS details and opt-out instructions.
Disclaimers
Services are provided "as is" without warranties of any kind, express or implied, except as required by law. We do not warrant that services will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Container Companies' total liability for any claim arising from these Terms or your use of services is limited to the amount you paid us in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Container Companies, its owners, employees, and contractors from claims arising from your misuse of services or violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Orleans Parish, Louisiana.
Changes to these Terms
We may update these Terms from time to time. Continued use of services after changes constitutes acceptance.
